The Medical Injury team at Ashtons Legal has been helping injured children and their families for over 25 years.
Each family has its own unique story and challenges, but they all have a common aim: to ensure their child has what they need to give them the best quality of life they can achieve, despite their circumstances.
This is our ethos too, ‘child first’, and it has been our privilege over the years to witness the transformation that can be achieved with the right equipment, therapies and accommodation.
Sadly, it is a fact of life that NHS and social services resources are limited. Charities like Just4Children provide vital fundraising help, for example for a wheelchair or surgery. But parents often approach us because they are desperate to fulfil their child’s full potential, provide for all their needs and to ensure that they are safe and looked after to their own standards for the whole of the child’s lifetime.
Why we are different
We understand it can be daunting to talk to a lawyer about possibly making a claim. Not every medical injury is the result of the failure of care, but we know only a fraction of people look into the circumstances of the injury. It is a vital part of our role to give honest and open advice to families from the outset and throughout the legal process.
We will support and steer you through every stage and will use our expertise to fight for your child’s claim. If your child’s injury was the result of negligence, as soon as we have an admission or an order recording that, we will straight away obtain funds from the defendant to meet your child’s immediate needs for equipment or therapies.
The legal process can be lengthy, however (see our Claimant’s Guide), and we know families face challenges and stresses on a daily basis. In order to help our clients while we investigate whether there is an entitlement to compensation, we have an in-house Client Liaison Manager who can provide our clients and the families with support and advice on a range of practical issues that inevitably arise when a child has a serious injury. These will include issues such as accessing or enhancing support from relevant statutory services for therapies, equipment, housing and education.
This service has been universally welcomed and praised by our clients and their families and it is a key part of our holistic and client-focused approach to a legal claim.
Another key service that sets Ashtons apart from other lawyers is our in-house Court of Protection team which assists our clients once we have obtained damages, whilst we value the claim and after the claim has finished. We can also call on other specialist services at Ashtons, if those are needed, for example in relation to property or the making of a statutory Will.
